KAMU İHALE S&#;RE&#;LERİNİN UYUŞMAZLIK KARARLARI &#;ER&#;EVESİNDE DEĞERLENDİRİLMESİ.

Abstract: The main objective of public procurement is to achieve the best possible price-quality balance and to complete it in a reasonable amount of time. When international and national documents are taken into account, it is seen that the compulsory principles and rules to be followed are developed in order to achieve the purpose of public procurement. When field-specific studies are examined, it is understood that the emphasis is on principles such as competition, transparency, value for money, equal treatment and reliability. The conceptual and application dimension of the competition principle in the study is examined. On the other hand, appeal applications, which resulted in the cancellation of tender due to the violation of the competition principle in by the Public Procurement Authority. As a result of the analysis, it was determined that the tenders canceled by the Authority tend to decrease, but it has been determined that the share of the tenders which have been decided to be canceled is following a regular course. Furthermore, in terms of violation of competition, it has been seen that some of the administrations have come forward in comparison with the other administrations, and competition has been mainly impeded due to the regulations of tender documents.
