La negoziazione assistita è un istituto di ADR (alternative dispute resolution), che si inserisce tra quelli finalizzati alla risoluzione alternativa delle controversie. Nello specifico, esso consiste nella redazione di una convenzione (c.d convenzione di negoziazione assistita), tramite la quale parti in lite convengono "di cooperare in buona fede e lealtà", al fine di risolvere in via amichevole una controversia, tramite l'assistenza di avvocati, per addivenire ad un accordo (c.d. accordo di negoziazione assistita).
È stato il c.d. "decreto giustizia" (d.l. n. /, convertito nella l. n. /), finalizzato a dettare "misure urgenti di degiurisdizionalizzazione e altri interventi per la definizione dell'arretrato in materia di processo civile" ad introdurre nel nostro ordinamento questo nuovo istituto, con la finalità di agevolare la migrazione dei contenziosi al di fuori delle aule dei tribunali, offrendo un’alternativa stragiudiziale per la composizione delle controversie.
Prescindendo in questa sede dall’elenco di tutti i diversi e numerosi ambiti in cui è applicabile la procedura della negoziazione assistita, che in alcune ipotesi analiticamente previste dal legislatore è obbligatoria, passiamo subito a parlare della operatività di tale proceduta nell’ambito della separazione e del divorzio. L'art. 6 del II capo del decreto giustizia è dedicato, infatti, proprio alla particolare ipotesi di negoziazione assistita in materia di separazione e divorzio, prevedendo tale norma la possibilità di applicare tale istituto, e dunque di raggiungere un accordo tra i coniugi, qualora si voglia addivenire alla separazione personale, alla cessazione degli effetti civili o allo scioglimento del matrimonio (nei casi di cui all'art. 3, 1° comma, n. 2, lett. b) della l. n. /), nonché alla modifica delle condizioni di separazione o divorzio precedentemente stabilite. Inoltre, alla luce della recente legge n. 76/ (c.d. legge Cirinnà) che regola le unioni civili e le convivenze di fatto, ferma la non applicabilità della negoziazione assistita per quest’ultima ipotesi, la procedura in oggetto è invece applicabile anche all’ipotesi di scioglimento dell’unione civile,visto l’espresso richiamo alla l. / effettuato dal comma 25 dell’art 1 della legge.
Qualora le parti, informate dai propri difensori, scelgano di optare per tale procedura, sarà compito degli avvocati quello di curare gli incontri di negoziazione con i propri assistiti e, trovata l'intesa, di redigere un accordo di separazione/divorzio/scioglimento dell’unione civile o modifica delle relative condizioni.
La negoziazione assistita è applicabile sia in assenza che in presenza di figli minori o di figli maggiorenni, incapaci, portatori di handicap grave ovvero economicamente non autosufficienti. Tuttavia, nel primo caso l'accordo raggiunto a seguito di convenzione di negoziazione assistita è sottoposto al vaglio del procuratore della Repubblica presso il tribunale competente, il quale, se non ravvisa irregolarità, comunica il nulla osta agli avvocati.
Nel secondo caso, invece, il PM, cui va trasmesso l'accordo entro 10 giorni dalla sua conclusione, lo autorizza solo se lo stesso è rispondente all'interesse dei figli.
Qualora, al contrario, il procuratore ritenga che l'accordo non corrisponda agli interessi della prole, lo trasmette, entro cinque giorni, al Presidente del tribunale competente, il quale, nel termine massimo di trenta giorni, dispone la comparizione delle parti, provvedendo senza ritardo.
Una volta concessa l’autorizzazione o il nulla osta, l'accordo, nel quale gli avvocati (almeno uno per parte) devono dare atto di aver esperito il tentativo di conciliazione tra le parti, informando inoltre queste ultime della possibilità di ricorrere alla mediazione familiare, è equiparato ai provvedimenti giudiziali che definiscono gli analoghi procedimenti in materia.
Tuttavia, dopo l’apposizione del visto all’accordo di negoziazione assistita, il legale di una delle parti ha l'obbligo di trasmetterne copia autenticata munita delle relative certificazioni, entro 10 giorni, a pena di sanzione amministrativa pecuniaria da a euro, all'ufficiale dello stato civile del Comune in cui il matrimonio fu iscritto o trascritto, perché si provveda a tutti gli adempimenti successivi necessari (trascrizione nei registri di stato civile, annotazioni sull'atto di matrimonio e di nascita, comunicazione all'ufficio anagrafe).
La procedura appena descritta, dunque, consente di intraprendere una via molto più rapida per addivenire ad una composizione delle liti familiari. Attraverso la negoziazione assistita, infatti, non occorre più presentarsi in Tribunale, con una riduzione considerevole dei tempi necessari per ottenere la separazione, il divorzio, lo scioglimento dell’unione civile o le modifiche di questi: tra la sottoscrizione dell'accordo di negoziazione assistita e la conclusione dell’iter passano solo pochi giorni, e solitamente, entro un mese l’intera procedura è conclusa.

¿Qué son?
Un implante dental es un sustituto artificial de la raíz natural del diente. Se trata de una pequeña pieza de titanio, material compatible biológicamente con los tejidos de la boca, que cicatriza en el hueso y se adapta de forma natural a las cualidades del hueso de los maxilares (mandíbula). La finalidad de los implantes es reponer las piezas ausentes de una forma fija, para devolver la función masticatoria y la estética de la sonrisa. Una vez que el proceso está concluido podrá volver a masticar con total normalidad sin notar diferencia con los dientes naturales.
El implante consta de tres partes:
- La prótesis o implante es la pieza base que se introduce en el hueso para que se osteointegre.
- El pilar es el elemento que unirá la prótesis con la corona.
- Y, por último, la corona es la porción visible de la prótesis que sustituye las funciones perdidas tras la ausencia de la pieza anterior. Pueden ser de zirconio, de metal o porcelana.
¿Qué procedimiento es el recomendado?
Lo primero que hay que decir es que cada caso clínico es personalizado, por lo que dependerá de cada persona, pero si es cierto que existen una serie de fases definidas:
&#; Fase de estudio. En ella se emplean todos los medios necesarios para determinar el mejor procedimiento a seguir. Se trata de una etapa clave ya que si se realiza correctamente evitará posibles problemas en el futuro. En esta fase se estudia la mordida, se mide la altura y el ancho de la pieza a examinar, se observa el tejido circuncidante y se realizan pruebas de diagnóstico por imagen, entre otras actuaciones.
&#; Fase quirúrgica. Dependiendo de los casos, pueden ser una o varias sesiones quirúrgicas. Estos procedimientos quirúrgicos se caracterizan por ser mínimamente invasivos por lo que las molestias postoperatorias suelen ser escasas.
&#; Fase restauradora. Para el desarrollo de esta fase suelen ser necesarias varias visitas ya que se lleva a cabo la fabricación del diente sobre el implante que ya disponemos en el hueso.
&#; Fase de mantenimiento. Para conseguir que el tratamiento sea duradero en el tiempo y evitar riesgos es necesario seguir las indicaciones de nuestros odontólogos especialistas.
